Terms of Service

By accessing or using Orbator.io ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Continued use of the Service after such modifications constitutes acceptance of the updated Terms.

You must be at least 18 years old to use this Service. By using Orbator.io, you represent that you meet this age requirement.

Orbator.io provides an automated banner rotation service for X (formerly Twitter) profile banners. Our Platform enables:

• Personal Banner Rotation: Automated scheduling and updating of custom banner images on X profiles
• Ad Monetization: Optional display of advertiser banners with revenue sharing (70% to creator, 30% platform fee)
• Campaign Management: Tools for advertisers to create, manage, and track banner ad campaigns
• Analytics: Performance metrics including impressions, engagement, and earnings

The Service requires integration with your X account via OAuth authentication. By using Orbator.io, you authorize us to update your X profile banner on your behalf according to your chosen settings.

Note: Orbator.io is a third-party service and is not affiliated with, endorsed by, or sponsored by X Corp.

Account Types:

• Creator Accounts: Users who rotate banners on their own X profiles (personal rotation or ad monetization)
• Advertiser Accounts: Users who create and fund campaigns to display ads on creator profiles
• Dual-Role Accounts: Users with both creator and advertiser capabilities

Account Security:

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access or security breach
• We use Clerk authentication to secure your account - see our Privacy Policy for details

X Integration:

To use our Service, you must connect your X account and grant OAuth permissions. You can revoke these permissions at any time via X settings, but doing so will disable all Orbator.io functionality for your account.

Subscription Tiers (Personal Banner Rotation):

• Free: $0/month - 4 manual rotations per month, 3 banners maximum
• Starter: $5/month or $48/year - 1 automated rotation per day (30/month), 10 banners
• Pro: $15/month or $144/year - 2 automated rotations per day (60/month), unlimited banners, analytics
• Business: $35/month or $336/year - 3 X profiles, 2 rotations/day per profile, API access, team features

Ad Monetization (Free Forever):

Creators who enable ad monetization earn 70% of revenue from advertisers. There is no subscription cost for ad monetization. Orbator.io retains a 30% platform fee.

Payment Processing:

• All payments are processed securely via Stripe
• Subscriptions automatically renew unless cancelled
• You can cancel your subscription at any time via Settings → Manage Subscription
• Upon cancellation, you retain access until the end of your current billing period
• We do not store your payment information - it is securely handled by Stripe

Refund Policy:

• Monthly subscriptions are non-refundable once charged
• Annual subscriptions may be eligible for pro-rated refunds within 30 days of purchase
• Refund requests must be submitted to support via Discord or email
• Campaign budgets for advertisers are non-refundable once impressions have been delivered

Price Changes:

We reserve the right to modify subscription pricing. Existing subscribers will be notified 30 days in advance of any price increases and will have the option to cancel before the new price takes effect.

Content Requirements:

• Banner images must be 1500x500 pixels (3:1 aspect ratio) or similar dimensions
• Maximum file size: 5MB per image
• Supported formats: PNG, JPG, GIF
• Images must comply with X's content policies and these Terms

Prohibited Content:

You may not upload or display content that:

• Violates any law or regulation
• Infringes intellectual property rights of others
• Contains malware, viruses, or malicious code
• Promotes illegal activities, violence, hate speech, or discrimination
• Contains explicit sexual content or nudity (except where permitted by X policies)
• Misrepresents your identity or affiliation
• Violates X's Terms of Service or content policies
• Constitutes spam, phishing, or fraudulent schemes

Content Moderation:

We reserve the right to review, reject, or remove any content that violates these Terms. Advertiser campaigns are subject to admin approval before going live. Repeated violations may result in account suspension or termination.

User Conduct:

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from our Platform
• Use automated tools (bots, scrapers) to access the Service without permission
• Interfere with or disrupt the Platform's operation or security
• Create multiple accounts to circumvent limits or restrictions
• Resell or redistribute access to the Service without authorization

Your Content:

You retain all ownership rights to the banner images and content you upload to Orbator.io. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to:

• Store and display your content on our Platform
• Update your X profile banner with your content as directed by your settings
• Display your content to other users (for advertisers: as part of approved campaigns)
• Create thumbnails and preview images for Platform functionality

This license terminates when you delete the content or close your account, except for content that has been shared or displayed to other users.

Platform Rights:

Orbator.io, our logo, design, and Platform features are protected by copyright, trademark, and other intellectual property laws. You may not use our branding without written permission.

DMCA Compliance:

If you believe content on our Platform infringes your copyright, please contact us with: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, and (4) a statement of good faith belief that the use is unauthorized.

Our Service integrates with and depends on third-party platforms:

• X (Twitter): OAuth authentication, banner updates, API access - subject to X's Terms of Service
• Stripe: Payment processing - subject to Stripe's Terms of Service
• Clerk: User authentication and session management - subject to Clerk's Terms
• Supabase: Data storage and database services - subject to Supabase's Terms

We are not responsible for the availability, functionality, or policies of these third-party services. Changes to third-party APIs or terms may affect Orbator.io functionality.

Important: If X suspends or terminates our API access, the Service may be disrupted or discontinued.

Termination by You:

You may close your account at any time via Settings. Upon account closure:

• Active subscriptions will continue until the end of the current billing period
• Banner rotations will stop immediately
• Your uploaded banners and data will be deleted within 30 days
• Unpaid earnings (if applicable) will be forfeited if below the payout threshold

Termination by Us:

We reserve the right to suspend or terminate your account if:

• You violate these Terms or our content policies
• Your payment method fails or you have unpaid balances
• Your account is inactive for more than 12 months
• We are required to do so by law or court order
• Continued operation of your account poses a security risk

We will attempt to notify you via email before termination, except in cases of severe violations or legal requirements.

Effect of Termination:

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect (including intellectual property provisions, disclaimers, and limitations of liability).

Service "As Is":

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Uptime Guarantee:

We do not guarantee that the Service will be uninterrupted, secure, or error-free. Scheduled and unscheduled maintenance may occur. We are not liable for any damages resulting from Service downtime.

X API Dependency:

Our Service depends on X's API. We are not responsible for failures caused by X API changes, rate limits, outages, or policy updates. X may suspend or revoke our API access at any time.

Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORBATOR.IO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Unauthorized access to or alteration of your content
• Errors, bugs, or viruses in the Platform
• Conduct or content of third parties on the Service
• Suspension or termination of your account

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification:

You agree to indemnify and hold harmless Orbator.io from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

Governing Law:

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Delaware.

Entire Agreement:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Orbator.io regarding the Service.

Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver:

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment:

You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.
